Divorce is one of those things that is never easy. Even if you are the one who decided to finally end the marriage, it likely wasn't an easy decision to make. It is estimated that anywhere between 45 and 50% of first-time marriages will end in divorce. Those numbers continue to climb the more marriages you have under your belt. Some divorces are easier to get finalized - this is usually when both parties are in agreement on everything.
However, some divorces are complicated and require a court battle. Here are three tips to help prepare you for contesting your divorce in court.
1. Check your emotional baggage at the door.
Divorce court is serious business. Not only do you need an attorney who knows what they are doing, you also need to keep your wits about you. That means you need to leave your emotional baggage out of the courtroom.
If your spouse cheated on you, that is only relevant if it was part of a pre-nuptial agreement. Otherwise, don't go on about it in divorce court. Instead, you need to think of the best way to convince the judge that you deserve the things you are asking for. If you come across as emotionally unhinged, it can actually hurt your case.
2. Be willing to compromise.
It is natural that you may want to get revenge against your spouse if the divorce was because of their infidelity. One of the best ways to do that is to be unwilling to yield on your demands. However, no good can come from that.
You need to demonstrate to the court that you are the "good guy," and you just want what you feel is fair. That may mean you need to be willing to give your spouse some of the things they want. For instance, if you want the vacation home at the beach, you may need to give them the house you both used as your primary residence.
Also, being willing to compromise can greatly reduce the amount of time it takes to settle and finalize your divorce. Less time in court means less money lost in attorney fees and other court costs.
3. Take care of yourself.
In a divorce that is being heavily contested, it can be easy to put your health on the back burner. After all, you have so much to worry about the longer the proceedings carry on. However, you need to take care of yourself despite the stress from the divorce case.
